THE OLIVE GROWS TERMS AND CONDITIONS OF KITCHEN USE

1. DEFINITIONS

In these terms and conditions (“Conditions”) the following expressions shall have the meanings ascribed to them below.1.1 “Company" means The Olive Grows,

“Location” means Unit A56, 7-11 Minerva Road, London NW10 6HJ

“the Hirer" means the legal entity with whom the Contract is made by the Company;

“Equipment" means, Cookers, Ovens, Fridges, Freezers, Tables, Trolleys and all ancillary Kitchen Equipment or articles or any of them (including any replacements or renewals thereof, additions thereto and substitutions thereof) made available at the Location;

“Product” means any ingredients, food and drink products and packaging used, stored or produced for third party consumption by the Hirer.

2. STATUS OF TERMS AND CONDITIONS

These Conditions accompany the Equipment Rental Terms and Conditions and shall apply for all periods of hire and at all times when the Hirer is on-site or in possession of the Company’s equipment or has any Product stored at the Location.

3. HIRER’S OBLIGATIONS

To ensure that all its representatives, employees, contractors and visitors who visit the Location, use the Equipment or handle Product:

• are familiar with the operating procedures of all Equipment and are able to use Equipment safely and appropriately;
• are aware of and conform to Health & Safety procedures in compliance with the Health & Safety at Work Act 1974 at all times. The Hirer is responsible for the health and safety of its own representatives, employees, contractors and visitors and should have in place appropriate policies, procedures and insurance to ensure legal compliance;
• share the Equipment with other Hirer’s safely and respectfully, with particular regard to cross-contamination;
• are provided with adequate information and instruction so that these obligations can be met;

Where appropriate, to register the Location as its production address with the relevant Environmental Health Office;

To observe relevant food safety legislation and be responsible for ensuring that its employees, contractors and representatives are adequately trained to handle all Product safely and to produce food and drink that is fit for consumption and that the Hirer’s own procedures are adequate for legal compliance;

To follow the Company’s procedures for cleaning and maintaining the Equipment and facilities, which require that the Equipment is left clean and sanitized, ready for the next Hirer;

To have in place appropriate and adequate insurance for its employees, representatives, contractors, visitors and Products;

To follow instructions and procedures in relation to the security of the Location and to report to the Company any incidents or circumstances that might cause a threat to such security;

To complete all paperwork as requested by the Company;

4. DISCLAIMER

The Company shall accept no liability for:

• Any loss or damage incurred by the Hirer to its Product or possession brought to, used or stored at the Location, howsoever caused;
• Injury or death to the Hirer’s employees, contractors, representatives or visitors whilst at the Location unless proven to be caused by the Company’s negligence

5. COMPANY’S RIGHTS

The Company reserves the right to take any action necessary to reduce any risk to its or its Hirers’ legal, safe and profitable operation, including but not limited to:

• the disposal of any Product stored at the Location which is deemed to be unfit for use or consumption or which is stored in contravention to Health & Safety requirements;
• to refuse access to the Location to any individual who poses a food safety risk;
• to refuse access to the Hirer, without notice, if it is found that the Hirer has been undertaking any illegal activity or activity not related to the production of food and drink at the Location;
• to provide information about the Hirer to the Environmental Health Office if and when such confirmation is requested in order to comply with its legal obligations.
